PIP Tribunal - Complete Guide 2026

How to Start an Appeal

After receiving your MR decision, you have one month to lodge an appeal. You can do this online at www.gov.uk/appeal-benefit-decision or by filling in form SSCS1 and posting it to HMCTS. Include a copy of your MR decision letter.

What Happens Next

  1. HMCTS acknowledge your appeal - within 1-2 weeks
  2. DWP prepare their response - they have 28 days to send their case to the tribunal
  3. You receive the DWP response - this includes the assessor's report and all evidence they used
  4. Hearing date is set - typically 4-8 months after lodging the appeal
  5. You attend the hearing - in person, by video, or by phone
  6. Decision is made - usually on the day

Oral vs Paper Hearing

Always request an ORAL hearing. Success rates are significantly higher at oral hearings because the panel can see and hear you describe your difficulties. Paper hearings rely only on written evidence and have lower success rates.

What Happens at the Hearing

The tribunal panel consists of a judge, a medical member (doctor), and a disability qualified member. They will ask you about your daily life and how your conditions affect you. The atmosphere is much more supportive than a PIP assessment - the panel is independent and not working for the DWP.

The hearing typically lasts 30-60 minutes. You can bring someone with you for support (a friend, family member, or representative). You do not need a lawyer.

The success rate is high because PIP assessments are often poor quality. Assessors miss information, make errors, and ignore evidence. The tribunal panel looks at everything fresh with independent medical expertise.

Don't give up after MR. MR has a very low success rate (about 20%). Tribunal has a 70% success rate. Many people give up after MR and lose thousands of pounds in PIP they were entitled to.

Backdating

If you win at tribunal, your PIP is backdated to the original date of claim. If your appeal took 12 months, that is a 12-month lump sum backpayment. This alone makes the appeal worthwhile.
